A GLIMPSE OF WHAT'S UP FOR AUCTION

TERMS & CONDITIONS

A 5% buyer’s premium, capped at $1,000 per item, will apply unless otherwise noted. All property is sold “AS IS,” and all sales are final. Bidders understand and acknowledge that they may not be able to inspect items as thoroughly as they could in person. Ultimately, it is the bidder’s responsibility to determine the condition, age, genuineness, value, or other determining factors of each item.

Ruhter Auction & Realty, Inc. will make every effort to accurately describe each item and provide pertinent information. However, Ruhter Auction & Realty, Inc. will not be responsible for errors or omissions in item descriptions unless there is a material and intentional misrepresentation.

Hour meter and odometer readings reflect what is shown at the time of consignment, but no guarantees are made regarding their accuracy. By bidding, the buyer agrees that all items are sold “AS IS” and acknowledges that no returns will be accepted.

PAYMENT INSTRUCTIONS

All items must be paid for by wire transfer within 24 hours of the auction. Ruhter Auction & Realty, Inc. will email invoices and wire transfer instructions to all winning bidders following the auction.

Credit card payments are accepted for purchases under $1,000; however, a 5% fee will apply to all credit card transactions.

TITLE FEES

A $25 title processing fee will be charged to the buyer on all titled items. Titles will be mailed by certified mail. Please allow up to 30 days for delivery.

Ruhter Auction & Realty, Inc. is not responsible for lost titles.

EQUIPMENT REMOVAL

Before removal, all items must be paid for in full and released by Ruhter Auction & Realty, Inc. All items must be removed from the seller’s location within 30 days of the auction. A $25-per-day storage fee will apply to any item not removed within that timeframe—no exceptions.

If the buyer fails to remove an item within 60 days, the item may be resold in the next available AuctionTime auction. All storage fees, handling costs, and commissions associated with removal and resale will be deducted from the final sale price. Any remaining proceeds will then be returned to the buyer who abandoned the item.

Please note that items in this auction are located at multiple locations. Buyers are responsible for reviewing the location of each individual lot and making appropriate pickup arrangements. The Squires Bros. equipment is listed in Fairfield, while the Kenworth is listed in Hastings.

RISK OF LOSS

Once payment is made, ownership transfers to the buyer, who assumes full responsibility for the purchased item, including theft, vandalism, fire, lack of security, accidental loss, and acts of God.

Buyers are responsible for removing all purchases within the required removal period.

LOADING

Loading arrangements will vary based on the location of the purchased item.

For items located at the Ruhter Auction & Realty, Inc. facility in Hastings, Nebraska, loading must be arranged between the buyer and Ruhter Auction & Realty, Inc.

For items located on a seller’s property, loading dates and times must be arranged directly between the buyer and seller. Ruhter Auction & Realty, Inc. will act strictly as a liaison between the parties.

Buyers are responsible for confirming loading requirements before arriving for pickup. Ruhter Auction & Realty, Inc. is not responsible for loading fees that may be charged by a seller.

Certain items may require the buyer to provide their own loading equipment. For example, the Allis-Chalmers forklift listing specifically states that there is no loading dock at the Fairfield farm and the buyer is responsible for loading the forklift, including providing the necessary trailer/ramps.
