When will the buyer receive possession?

Possession is March 1, 2027. The purchase balance is due on or before December 18, 2026, as outlined in the terms and conditions.

Terms & Conditions

A payment equal to 10% of the purchase price will be due the day of the auction. The remaining balance will be due on or before December 18, 2026, and must be paid by certified funds or direct wire transfer to Southern Title, which will handle title insurance and closing. Preliminary title work is available. Possession will be granted March 1, 2027.

The sellers will pay all 2025 and prior real estate taxes, while the buyer will be responsible for all subsequent taxes. Title insurance costs will be split equally between buyer and seller. The sellers will convey fee simple title, subject to existing highways, easements, reservations, or encumbrances of record on file with the Adams County Register of Deeds.

AUCTION METHOD & REGISTRATION

This property will be offered in 2 tracts through a simulcast auction, with live and online bidding. Both tracts will close at the same time. Final bids are subject to seller confirmation and acceptance.

Online bidding will be available with prior approval. Please register at ruhterauction.land at least 48 hours before auction day. Late registrations shall be accepted at the discretion of Ruhter Auction & Realty, Inc. Online bidders must speak with a company representative to complete the bidding approval process.

Bids will be recognized in the order received. In the event of a tie between an internet bidder and a bidder on the floor, the floor bid will receive priority. Internet connections may be delayed or unreliable as the sole source of communicating a bid to the Auctioneer. Neither the seller nor Ruhter Auction & Realty, Inc. will be responsible for internet connections or delayed bidding. Auction Software and Ruhter Auction & Realty, Inc. will not be held liable for software malfunctions.

By placing a bid, you are entering into a contractual agreement with the seller to purchase the real estate should you be the highest bidder. Failure to follow through with your role in the transaction will result in negative consequences up to and including legal action to recoup damages caused to the seller due to breach of contract.

The winning bidder will be notified of acceptance of the high bid immediately after the auction closes and will be required to enter into a standard purchase agreement with the seller. Under the internet bidding terms, a non-refundable earnest money deposit of 10% of the sale price will be required within 24 hours.
