TERMS & CONDITION
 

A 5% buyer’s premium, capped at $1,000 will apply unless otherwise noted. All property is sold “AS IS”, and all sales are final. Therefore, bidders understand and acknowledge they may not be able to inspect items as thoroughly as they could in person. Ultimately, it is the bidder’s responsibility to determine the condition, age, genuineness, value, or other determining factors of the item.

Additionally, Ruhter Auction and Realty, Inc. will make every effort to describe each item in detail and provide any pertinent information. However, the company will not be responsible for any errors or omissions in the item descriptions unless there is a material and intentional misrepresentation.

Hour meter and odometer readings reflect what is shown at the time of consignment, but no guarantees are made regarding accuracy. By bidding, the buyer agrees that all items are sold “AS IS” and acknowledges that no returns will be accepted.

PAYMENT INSTRUCTIONS
 

All items must be paid for by wire transfer within 24 hours of the auction. Ruhter Auction & Realty, Inc. will email wire transfer instructions and invoices to all winning bidders after each item is sold.

Additionally, credit card payments are accepted for items under $1,000; however, a 5% fee will apply to all credit card transactions.

TITLE FEES
 

There is a $25 title processing fee on all titled items, which will be charged to the buyer. Titles will be mailed by certified mail. Please allow up to 30 days for delivery.

Furthermore, Ruhter Auction & Realty is not responsible for lost titles.

EQUIPMENT REMOVAL
 

Before removal, all items must be released by Ruhter Auction & Realty, Inc. Additionally, all items must be removed from the seller’s location within 30 days of the auction. A $25/day storage fee will apply to any item not removed within that timeframe—no exceptions.

If the buyer fails to remove the item within 60 days, the item may be resold in the next available AuctionTime auction. All storage fees, handling costs, and commissions associated with removal and resale will be deducted from the final sale price. Afterward, any remaining proceeds will be returned to the buyer who abandoned the item.

RISK OF LOSS
 

It is the buyer’s responsibility to pick up all items within 30 days of purchase. Once payment is made, ownership transfers to the buyer, who then assumes full responsibility for theft, vandalism, fire, lack of security, accidental loss, and any acts of God.

LOADING

Loading for items located at the Ruhter Auction & Realty, Inc. facility in Hastings, NE must be arranged between the Buyer and Ruhter Auction & Realty, Inc. For items located on the Seller’s property, loading times and dates must be arranged directly between the buyer and seller, with no exceptions. Ruhter Auction & Realty will act strictly as a liaison between both parties.

Moreover, the auction company is not responsible for any loading fees that the seller may charge.
